Terms of Service

These Terms of Service ("Terms") govern the use of the services provided by WAGMI TECH, SOCIEDAD DE RESPONSABILIDAD LIMITADA ("WAGMI TECH", "we"), including the artificial intelligence agent "Eugenia" and related WhatsApp support services. By using our services, you accept these Terms.
1. Service description
WAGMI TECH provides technology that lets companies serve, qualify and follow up with their customers over WhatsApp using artificial intelligence, with the option to transfer the conversation to a human agent. WAGMI TECH acts as a technology provider for those companies.
2. Acceptable use
You agree not to use the service for: unlawful activities; sending spam or unsolicited messaging in violation of WhatsApp/Meta policies; impersonation; uploading content that infringes third-party rights; or any attempt to breach the security of the system.
3. Compliance with Meta and WhatsApp policies
Use of the service is subject to the WhatsApp platform policies, including the WhatsApp Business Policy and the WhatsApp Business Terms. Non-compliance with those policies may result in suspension of the service.
4. Accounts and credentials
Client companies are responsible for the accuracy of their account information and for keeping their credentials confidential. Each company is responsible for the content and legality of the communications it sends through the service.
5. Intellectual property
The software, the WAGMI TECH brand, the Eugenia agent and all associated materials are the property of WAGMI TECH. No license is granted except as necessary to use the service as agreed.
6. Availability and support
We aim for high service availability, but the service is provided "as is" and may experience interruptions due to maintenance, third-party failures (including the WhatsApp platform) or force majeure. Specific service-level and support conditions are agreed with each client company by contract.
7. Limitation of liability
To the maximum extent permitted by law, WAGMI TECH shall not be liable for indirect, incidental or consequential damages arising from the use or inability to use the service. Responses generated by artificial intelligence may contain errors; the client company is responsible for supervising and validating critical information communicated to its customers.
8. Privacy
The processing of personal data is governed by our Privacy Policy.
9. Changes
We may update these Terms. The current version will be posted on this page with its update date. Continued use of the service implies acceptance of the changes.
10. Governing law
These Terms are governed by the laws of the Republic of Honduras. Any dispute will be submitted to the competent courts of San Pedro Sula, Honduras.
